Terms of Service of the Yettel Zelene Staze Application


General Provisions


Yettel d.o.o. Belgrade, Omladinskih brigada 90, Tax ID: 104318304, company registration number: 20147229 (“We” or “Yettel”), through the “Yettel Zelene Staze” application within the “Yettel” software application, enables users of that application to access various content and other advertising activities of third parties (“Partners”). Through this application, we also make our own content and advertising activities available to users. Within the content displayed in the “Yettel Zelene Staze” application (“Application”), users are provided access to other services of Partners and Yettel, digital services, coupons, vouchers, discount codes, etc.

Access to the Application may be obtained by a user who uses the Internet on their mobile device, has installed the “Yettel” application, and has agreed to these Terms of Service. The user of the Application may be any Yettel prepaid or postpaid private or business user (except those users who use packages specifically marked on the Yettel website), as well as a person who uses the mobile telephony services of another operator. A prepaid user of the Yettel mobile network will not have access to the Application if more than 90 days have passed since their last top-up. When accessing the Application, the user must register, unless they have already registered when using the “Yettel” application.
By accepting these Terms of Service by selecting the appropriate field in the Application, the user confirms that they are familiar with and agree to all of its provisions and fully accept them.


Limitation of Liability


Yettel fully disclaims, within the limits of the law, any responsibility (I) that may in any way arise from the use of the Application or be in any way connected with its use, (II) for any actions of the user involving use or misuse of the Application’s content, and (III) for any damage that may be caused to the user or any third party in connection with the use or misuse of the Application’s content.

Yettel shall not be liable if, due to technical or other errors, you cannot access the Application or its content. If you cannot access the Application due to technical or other errors, you may call our contact center at 063/9000, and we will, upon your request, take all necessary measures to resolve that technical difficulty.

We reserve the right to deny the user access to the Application without prior notice if we determine that the user has misused access to the Application.

Use of “Google Maps” within the Application is subject to the Terms of Service of Google Inc. Yettel and the Partners bear no responsibility for any inaccurate presentation of locations, terrain appearance, or other properties of the display on “Google Maps.” For any issues related to the use of “Google Maps,” users may contact Google Inc. customer service.

Yettel and the Partners (including the Mountain Rescue Service of Serbia) disclaim all responsibility in relation to the accuracy of routes and descriptions presented in GPS tracks, which are an integral part of the Application. Content created by the Mountain Rescue Service of Serbia is of an informational nature.

Staying in the mountains, mountain biking, hiking, and other activities are high-risk activities and require adequate experience, physical preparation, and a high level of awareness of the dangers that such activities may cause.

The accuracy of the information contained in GPS tracks and descriptions presented in the Application may vary depending on the strength of the GPS signal, the accuracy of the GPS device, weather conditions in the field, the season, etc. Descriptions presented by photographs do not necessarily represent the actual condition of the terrain.

Yettel and the Mountain Rescue Service of Serbia urge that all precautionary measures be taken when engaging in the mentioned activities.


Privacy Notice


Yettel processes personal data of the Application users in the manner and in accordance with Privacy Notice.


Copyright


Documents, data, and information published in the Application may not be reproduced, distributed, or used in any way for commercial purposes (without the explicit consent of Yettel and third parties – content owners) or in any manner that could cause harm to Yettel or any third party. Documents, data, and information published in the Application may only be used for the individual needs of the user, in compliance with all copyright and proprietary rights, as well as the rights of third parties.


Final Provisions


App Updates and Modifications
Yettel reserves the right to amend the content of the Application without special notification to users, and Yettel shall not be liable for any possible consequences arising from such changes.

Jurisdiction
The relationship between the user and Yettel is governed by the applicable laws of the Republic of Serbia. Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts in Belgrade.
 

The Terms of Service were published on 17.01.2023 on the Yettel website.
The Terms of Service enter into force and apply from 01.01.2023.
